European Court considers UN terrorlist not reviewable; individuals in the cold

This past week, on 21 September 2005, the Court of First Instance of the European Court of Justice (“ECJ”) rendered two most important, yet little reported opinions in the context of the international efforts to combat terrorism through resolutions of the UN Security Council. In a nutshell, the ECJ considered the European legal system to be subordinate to the general international legal order, which is not that remarkable. However, it also acknowledged that an individual has no comprehensive international, European or national legal recourse to appeal the decision of the Security Council Sanction Committee to put his or her name on a terror watch list and freeze all that individual’s assets. This latter aspect was not really acknowledged or emphasized in the few reports about the case.
